1. Agreement to Terms

By booking a yacht charter service with wandriira, you agree to be bound by these Terms and Conditions. This agreement constitutes a legal contract between you (the "Guest") and wandriira (the "Company"). If you do not agree with any part of these terms, please do not proceed with your booking.

These terms apply to all sailing experiences, including sunset sails, island hopping cruises, and extended coastal voyages.

2. Booking and Payment

2.1 Reservation Process

Bookings are confirmed upon receipt of a deposit payment. Final payment is due 14 days before the scheduled departure date. Reservations made within 14 days of departure require full payment at the time of booking.

2.2 Pricing

All prices are quoted in Malaysian Ringgit (MYR) and include crew fees, fuel, basic equipment, and provisions as specified in the service description. Prices do not include optional add-ons, personal expenses, or gratuities unless explicitly stated.

2.3 Payment Methods

We accept payment via bank transfer, credit card, and approved online payment platforms. Processing fees may apply for certain payment methods and will be disclosed before transaction completion.

3. Cancellation and Refund Policy

3.1 Guest Cancellations

  • More than 30 days before departure: Full refund minus 10% administrative fee
  • 15-30 days before departure: 50% refund
  • Less than 15 days before departure: No refund

Deposit payments are non-refundable in all circumstances unless the Company cancels the voyage.

3.2 Company Cancellations

wandriira reserves the right to cancel voyages due to weather conditions, mechanical issues, or circumstances beyond our control. In such cases, guests will receive a full refund or the option to reschedule at no additional cost. The Company is not liable for any consequential expenses such as travel arrangements or accommodation bookings.

3.3 Weather-Related Changes

The Captain has final authority over sailing decisions based on marine forecasts and safety assessments. If a voyage is shortened or rerouted due to weather conditions after departure, no refunds will be provided, though we will make reasonable efforts to provide alternative experiences.

4. Guest Responsibilities

4.1 Age and Fitness Requirements

Guests must be at least 18 years old or accompanied by a parent or guardian. All participants should have reasonable physical fitness for boarding vessels and moving about on deck. Guests with mobility concerns should inform us in advance so appropriate accommodations can be arranged.

4.2 Health Disclosure

Guests must disclose any medical conditions, allergies, or health concerns that could affect their safety or require special attention during the voyage. Failure to disclose relevant health information may result in denial of service without refund.

4.3 Conduct and Behavior

Guests are expected to follow crew instructions, respect other passengers, and refrain from behavior that compromises safety or enjoyment. The Captain may terminate participation of any guest whose conduct is deemed dangerous or disruptive, with no refund provided.

4.4 Alcohol and Substances

Moderate alcohol consumption is permitted at the Captain's discretion. Illegal substances are strictly prohibited. Guests under the influence may be denied boarding or removed from the vessel.

5. Safety and Insurance

5.1 Maritime Insurance

All voyages are covered by comprehensive maritime liability insurance. Guests are strongly encouraged to obtain personal travel insurance covering medical emergencies, trip cancellations, and personal belongings.

5.2 Safety Briefings

All guests must attend the pre-departure safety briefing and understand the location and use of life jackets, emergency equipment, and communication devices. Life jackets must be worn when directed by the crew.

5.3 Emergency Procedures

In the event of a maritime emergency, the Captain's instructions are to be followed without question. The Company maintains emergency protocols in coordination with Malaysian maritime authorities and coast guard services.

6. Limitation of Liability

To the maximum extent permitted by Malaysian law, wandriira's liability is limited as follows:

  • The Company is not liable for delays, cancellations, or itinerary changes caused by weather conditions, mechanical failures, or force majeure events
  • Personal injury claims are subject to maritime liability limits under Malaysian law
  • The Company is not responsible for lost, stolen, or damaged personal belongings
  • Liability for service quality issues is limited to the charter fee paid
  • We are not liable for consequential or indirect damages including travel expenses, lost time, or emotional distress

7. Intellectual Property

All content on our website, marketing materials, and voyage documentation, including text, images, logos, and design elements, is the property of wandriira and protected by Malaysian copyright laws. Guests may not use, reproduce, or distribute our intellectual property without written permission.

Guests grant wandriira permission to use photographs or videos taken during voyages for marketing purposes unless they explicitly opt out in writing.

8. Privacy and Data Protection

Personal information collected during the booking process is handled in accordance with our Privacy Policy and Malaysian Personal Data Protection Act 2010. By booking our services, you consent to the collection, use, and storage of your information as described in our privacy policy.

9. Amendments and Modifications

wandriira reserves the right to modify these Terms and Conditions at any time. Changes will be posted on our website with an updated effective date. Bookings made before changes take effect will be governed by the terms in place at the time of booking.

Any modifications to specific bookings (dates, guest numbers, vessel assignments) must be agreed upon in writing by both parties.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Malaysia. Any disputes arising from or related to our services shall be subject to the exclusive jurisdiction of the courts in Johor Bahru, Malaysia.

Before pursuing legal action, parties agree to attempt resolution through good-faith negotiation or mediation.

11. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect. The invalid provision will be modified to the minimum extent necessary to make it valid and enforceable.

13. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and wandriira regarding yacht charter services. They supersede all prior agreements, understandings, or representations, whether written or oral.
